Terms of use
Contract terms for using E-School, including fair use, fees, and changes to these Terms.
1. Agreement
These Terms of Use (“Terms”) govern access to and use of the E-School Management System (“E-School”, the “Service”) and related marketing site operated by 360 Software House Spółka z ograniczoną odpowiedzialnością (“Operator”, “we”, “us”). The Service is offered primarily to schools in Uganda (SaaS plan prices in UGX). By starting a trial, registering, paying for a plan, or using the Service, you agree to these Terms and our Privacy Policy and Fair Use Policy.

3. The Service
E-School is hosted software for school operations (including attendance, gradebook, UGX fee workflows, library, clinic, stores/budget where enabled, and role-based portals). Features may vary by plan, configuration, and release. The trial period may be limited in time and features.
Online parent Pay Now and live SMS carrier delivery are roadmap items and are not part of the current product. Office broadcasts use school email (HTML) via SMTP when configured by the school.
Application data is hosted in Poland, European Union on infrastructure operated by the Operator. See the Privacy Policy for processing roles and transfers.
4. Accounts and customer responsibility
You agree to provide accurate registration details, protect credentials, and ensure only authorised staff use the tenant. The school organisation is responsible for the lawfulness of personal data it enters (staff, students, guardians, parents) and for notices/consents required under Uganda’s Data Protection and Privacy Act. A separate data-processing agreement (DPA) is available on request or as part of a commercial contract.
You must not share admin credentials publicly, attempt to access other tenants’ data, or circumvent security or entitlement controls.
5. Fees, trials, and currency
After the trial, paid plans require an active subscription. SaaS plan prices are listed in UGX on the Pricing page (per term or academic year). Billing methods may include invoice or card checkout when configured. Fees are non-refundable except where mandatory law or a written commercial agreement provides otherwise. We may change list prices prospectively with notice; existing prepaid periods are handled as stated in your order or invoice.
6. Fair use, storage, and abuse
Use of the Service is subject to our Fair Use Policy, which forms part of these Terms. In summary:
- Included object storage is limited (default soft quota 5 GB per active school tenant unless a written plan or add-on states otherwise).
- Per-file upload limits apply (typically up to 25 MB for general files and 2 MB for certain media), as enforced by the product.
- The Service must not be used as a general-purpose backup drive, video archive, or personal cloud unrelated to school operations.
- We may throttle, block uploads, require cleanup, charge for excess capacity, or suspend the tenant after notice where fair-use limits are exceeded or abuse is detected.
7. Acceptable use
You must not:
- upload unlawful, harmful, or infringing content;
- probe, scan, or attack the Service or other customers;
- scrape or extract data except via documented APIs and your own tenant permissions;
- resell or white-label the Service without our written consent;
- interfere with metering, entitlements, or security controls.
We may suspend or terminate access for material breach, unpaid fees after notice, abuse, legal risk, or fair-use violations.
8. Intellectual property
E-School software, branding, and documentation remain the property of 360 Software House or its licensors. Schools retain rights in their own data and content uploaded to their tenant. Feedback you provide may be used to improve the Service without obligation to you.
9. Availability and support
We aim to keep the Service available and to address incidents with reasonable skill and care. Unless a separate SLA is signed, the Service is provided on an “as available” basis. Planned maintenance and emergency security patches may cause downtime.
10. Limitation of liability
To the extent permitted by applicable law, 360 Software House is not liable for indirect, incidental, special, or consequential loss; loss of profits, data, or goodwill; or loss arising from customer data entry errors, third-party networks, customer misconfiguration, or features expressly marked as unavailable (such as live Pay Now / SMS). Our aggregate liability arising out of these Terms in any twelve-month period is limited to the fees paid by the affected school for the Service in that period (or UGX zero for an unpaid trial), except where liability cannot be limited under mandatory law (including for death or personal injury caused by negligence, or fraud).
11. Customer indemnity
The school customer will defend and indemnify the Operator against claims arising from the school’s content, unlawful processing instructions, or use of the Service in breach of these Terms, to the extent permitted by law.
12. Changes to these Terms
We may amend these Terms (and related policies linked from them) from time to time. The “Last updated” date will change. For material changes we will provide notice by one or more of: posting on this website, in-product notice, or email to the school administrator contact on file. Material changes become effective after at least 14 days from notice, unless earlier effect is required for security, legal compliance, or to prevent abuse or material cost overrun (including fair-use enforcement). Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and may request export / closure of the tenant under our retention practices.
13. Governing law and disputes
These Terms and the SaaS contract with 360 Software House are governed by the laws of Poland, without prejudice to mandatory protections that may apply to you as a school customer in Uganda. Disputes should first be raised with contact@eschoolmanagementsystem.com. Courts competent for the Operator’s registered seat in Łódź, Poland, shall have jurisdiction, unless mandatory law provides otherwise.
14. Miscellaneous
If a provision is unenforceable, the remainder stays in effect. These Terms (plus Privacy, Fair Use, Cookies, order forms, and any signed DPA/SLA) are the entire agreement for the Service and supersede prior marketing statements. Failure to enforce a provision is not a waiver.
